FUELING AT CSXT FRONTIER
I discussed with the International the
recently initiated practice of having road crews take power to and/or from
Frontier for the purpose of fueling.
They believe we have a sound basis for claim in many circumstances.
CLAIM IS VALID IF:
You deliver your train to a location on
NS property and then deliver your power to Frontier. You are not in interchange service and cannot be required to
deliver your power to a foreign railroad without penalty. Submit a PE claim stating the following in
the remarks.
“Allow
one day’s pay account ordered by Bison Yardmaster Laura to deliver our engine
consist to the Frontier Diesel Pad on the CSXT Railroad. We were not in interchange service and this
is outside of the scope of Incidental work that may be required of us.”
If you deliver power to Frontier and
bring it back, write:
“Allow
one day’s pay account ordered by Bison Yardmaster Cherrie to deliver our engine
consist to the Frontier Diesel Pad on the CSXT Railroad. We were then required to wait for the
engines to be serviced and then returned them to Tiftt Street Yard for outbound
train #15M. We were not in interchange
service and this is outside of the scope of Incidental work that may be
required of us.”
If you deliver your train to Frontier,
you may deliver the power to the (1) Frontier engine tracks (i.e. the Diesel
Pad or Loop Tracks), (2) the tracks immediately adjacent to the track you
yarded on, or (3) back to NS (but not after fueling. If required to place your power on an outbound train at Frontier
or bring it back to Bison after fueling, submit a penalty:
“Allow
one day’s pay account required to place our engine consist on an outbound train
at CSXT’s Frontier Yard after interchanging cars to CSXT on South Yard Track
#6. After delivering our train we were
ordered by the CSXT Hump Yardmaster to place our power on an outbound train on
North Yard Track #5. This is beyond the
scope of Incidental Work that may be required of us.”
or,
“Allow
one day’s pay account required to take our engine consist from CSXT’s Frontier
Diesel facility back to Bison Yard after interchanging our train to CSXT at
Frontier Yard and delivering the power to the CSXT engine facility. The move back to Bison was for the purpose
of delivering this power to an outbound train #309. This done per orders of NS Trainmaster Brian Bell.”
If you run into any other variables of
this theme, please let me know and I will help you construct language for your
claim. As with all claims, you should
print a copy of the claim and the remarks and forward both to me as soon as you
receive a denial. I would need the
denial language as well either from the CrewCall system or from the “Detail of Earnings and Declinations” mailed to you by NS.

interchange service to either CSXT, the D&H or the B&P and are required
to make “extracurricular” moves, let me
know. Even though we are all in “road service” in Buffalo, the agreements on interchange service are far more
restrictive and penalty pay accrues far more often.
